General Information on the Terms of Use of Our Services (Online Shop)
The use of the services provided by the online shop of Pitter d.o.o., Tkon 88, Tkon, Croatia, OIB: 44369220053 ("Pitter" or "we"), your contractual relationship and your interaction with us are subject to these Terms of Use ("Terms").
These Terms form an integral part of the purchase agreement concluded through the order of products and services offered on our website. They also serve as pre-contractual information within the meaning of the applicable Croatian consumer protection legislation.
Croatian law applies, in particular the Consumer Protection Act, the Electronic Commerce Act, and the Obligations Act.
These Terms must be read carefully before placing an order through the online shop. Buyers are obliged to familiarize themselves with the current version of the Terms before each order, as they may change over time. The Terms govern the use of the website by buyers.
By using the website, users are considered to have been informed of these Terms and to fully agree to them. Any changes or cancellations of the Terms take effect upon their publication on the website, unless otherwise stated.
The communication language is Croatian, which does not exclude the simultaneous use of other languages.
Pitter places particular importance on the protection of your privacy and personal data. Further information can be found in our Privacy Policy and Cookie Policy on our website.
Terms in these conditions that include a gender-specific grammatical form apply equally to all genders.
By using this website, you acknowledge that (a) this website is made available free of charge; and (b) IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, INCLUDING THE DISCLAIMER, DO NOT USE OUR SERVICES.
Definitions
For the purposes of these Terms, the following terms have the following meanings:
Customer: Refers to the consumer, provided that the purpose of the order of goods and services cannot be primarily attributed to their commercial or self-employed professional activity. Customer and seller agree to comply with these Terms and other legal provisions for distance selling.
Shopping Cart: A virtual storage location where the products selected by the customer for purchase are stored. The shopping cart contains an overview of all selected items, including their quantity for further ordering.
Applicable Law: Refers to the law of the Republic of Croatia as well as the law of the European Union and other directly applicable legal norms in Croatia.
Personal Data: All information relating to an identified or identifiable natural person ("data subject"). A person is considered identifiable if they can be identified directly or indirectly by name, identification number, location data, online identifier, or other characteristics.
Offer: Refers to the offer to conclude a purchase contract, which is created and transmitted based on the content of the shopping cart and the order submitted by the customer.
Confidential Information: All information, data, and trade secrets exchanged between Pitter and the customer in the course of their collaboration.

Business Day: A working day under Croatian law, excluding weekends and public holidays.
Force Majeure: An event beyond Pitter's control and unforeseeable, such as war, uprisings, terrorist acts, natural disasters, epidemics, power outages, telecommunications failures, government decisions, etc.
Webshop: Refers to the term "Online Shop" as available on the website www.pitter-croatia.com.
Electronic Communication
When you visit our website, contact us through it, send us an email, or contact us by phone, you communicate with Pitter electronically. We communicate with you by email, phone, or by posting notices on our website.
The conclusion of contracts for our services, however, is carried out directly through the website and by email (see details below).
Purchase, Payment, and Delivery Terms
Pitter provides an overview of the main conditions for purchase, payment methods, and delivery below. For clarity, this is presented in the form of frequently asked questions:
Where can I find the product range and prices? All products are listed on our website. Each product includes a description, an image, and the price. Images are for illustrative purposes only and may differ from the actual products available. For more detailed information, please contact us at webshop@pitter-croatia.com.
All prices are stated in euros (EUR) excluding VAT and apply only for orders placed through the website. Before submitting the order, you will be shown the total price including taxes and delivery costs.
The price in the order summary is provisional; the final price will be sent via a separate email offer after your order has been reviewed. This may vary slightly due to, for example, additional delivery costs.
Pitter reserves the right to change prices and product information without prior notice. However, such changes do not apply to orders already placed. Price changes may also result from currency fluctuations.
In case of pricing errors or other mistakes, Pitter reserves the right to make corrections.
How do I order products? You order via the website and email (provided during the order process). Products are selected by clicking "Add to Cart." You can find your cart at the top of the page, where you can also remove items.
In the next step, review your selection, delivery costs, and taxes in the "Checkout" section. Then enter your personal and delivery details and click "Confirm Order."
Please enter accurate and complete data during the ordering process – you are liable for any costs or consequences arising from incorrect information.
After submitting the order, you will receive an offer with all details via email. By paying the amount stated in the offer (including the offer number as payment reference), you accept the offer. The contract is concluded upon receipt of payment. You will also receive confirmation of the contract by email.
With the delivery, you will receive written confirmation of the contract.
What if the product is not available? In exceptional cases, a product may be temporarily unavailable, even though it is displayed online. In such cases, we will notify you immediately by email.
If you saw a product during a previous search that is no longer displayed, send us an inquiry by email or via the contact form on the website. Our team will be happy to assist you.
What payment methods are available? Payment is made exclusively by bank transfer. This payment is also considered acceptance of the offer.
When will the delivery take place? Delivery is usually carried out by courier service within Croatia. The delivery period is stated in the offer and begins from the date the payment is received.
Pitter is not liable for delivery delays caused by force majeure or third parties. In the event of a delay, the customer will be informed by email – either by Pitter or directly by the courier service.
Delivery takes place on business days.
If delivery is not possible due to force majeure, the delivery period will be extended accordingly.
Upon delivery, the customer will receive all product-related documents (instructions, technical data, declaration of conformity, warranty card if applicable), an invoice, and a delivery confirmation, which must be signed.
What should I do in the case of damaged or defective goods? By signing upon receipt, you confirm that the package is externally undamaged.
If the goods are nevertheless defective (e.g., incorrect product, missing accessories, incomplete delivery, or incorrect instructions), please inform us at webshop@pitter-croatia.com. Material defects are assessed according to Croatian law.
If Pitter is responsible for the defect, we will rectify it free of charge or replace the product.
Right of Withdrawal
You have the right to withdraw from the purchase agreement within 14 days after receiving the goods without stating a reason, if the purchase was made online or outside business premises.
To exercise the right of withdrawal, you must clearly inform Pitter of your decision – by form (link to be inserted) or by email (email address to be inserted).
In the event of withdrawal, Pitter will refund the purchase price including delivery costs (except in the case of non-standard delivery) within 14 days of receipt of the withdrawal. The refund will be made using the same method as the payment.
The goods must be returned at your own cost within 14 days of the withdrawal. The customer is only liable for any reduction in value resulting from handling the goods in a manner not necessary to establish their nature, characteristics, and functioning.
The products must be returned unused, in their original condition, and in their original packaging.
Warranty
If the manufacturer of a product offers a warranty, Pitter will include all relevant warranty documents with the product shipment. The manufacturer is responsible for the functionality of the product in accordance with the warranty terms provided.
Complaints Procedure
As a customer, you have the right to submit a written complaint about the services of Pitter either by email to webshop@pitter-croatia.com or by post to Tkon 88, 23212 Tkon, Croatia.
You will promptly receive confirmation of receipt of your complaint. Within 15 days, you will receive a written response with a clear statement on whether your complaint is deemed justified.
Disputes related to online purchases can also be submitted via the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr). If both parties agree, the dispute may be submitted to a recognized alternative dispute resolution body.
Liability for Damages
Customer claims for damages related to purchased goods are excluded unless they are based on intent, gross negligence, statutory product liability, or damage to life, body, or health.
Pitter’s liability under these conditions is also limited to its employees, representatives, and agents.
Pitter is not liable for damages resulting from the use of the website beyond its intended purpose.
Intellectual Property
By purchasing a product, the customer does not acquire any rights to use trademarks of Pitter or other companies. The product may also not be disassembled or analyzed in order to reproduce it.
Products may not be used in a way that harms Pitter's reputation or for illegal purposes. Any resulting damages shall be borne by the customer.
Plans, drawings, offers, and technical documentation remain the intellectual property of Pitter or third parties. Any use, reproduction, or publication requires written consent.
The customer is obliged to inform Pitter of any known violations of intellectual property rights.
Confidentiality
All confidential information (especially business, financial, or technical content) is considered trade secrets and may not be used or disclosed without Pitter's consent. Upon request, such information must be returned or destroyed.
Data Protection
The customer’s personal data will be processed exclusively for the purpose of contract performance and in accordance with applicable data protection laws (in particular the GDPR).
Final Provisions
Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected. The legally permissible provision that comes closest economically to the invalid provision shall apply.
Croatian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
All disputes shall fall under the jurisdiction of the Commercial Court in Zadar.
These Terms take effect upon their publication on the Pitter website. Changes will be published there and communicated in accordance with the Terms.
